Authored by one of the leading authorities in the field, this account of the modern law of contract is a popular text with students and lecturers alike. Presenting a unique balance of 40% text to 60% cases and materials, the book can be used both as a stand alone text and as a companion volume to a short introductory textbook. Through this fresh approach to the subject, students obtain a firm understanding of the central doctrines and associated controversies. Comprehensive coverage is presented in a logical structure that maps closely onto courses, and stimulating commentary is delivered through detailed introductions, extract notes and extensive comments within each chapter.

Extended extracts illustrate points clearly, and promote the essential skills of case-reading, encouraging more detailed analysis of salient points, while analysis of key academic commentaries on issues of controversy, contract clauses etc is also included to provide a well-rounded discussion.Extracts from materials such as the Principles of European Contract Law, and the UNIDROIT Principles for International Commercial Contracts are incorporated throughout to provide a useful point of comparison with English Law – encouraging critical reflection upon the state of the English system and illustrating how the law of contract is regarded in other jurisdictions.

Specimen clauses are also cited to demonstrate some of the practical problems that confront both businessmen and lawyers, offering students working examples of complex issues. Questions are placed at key points throughout the text to encourage further consideration and reflection of complex or controversial issues, while extensive referencing promotes further research. Written in a familiar and engaging style, this book offers a thought-provoking and well-balanced argument aimed squarely at undergraduates.

Online Resource Centre * Updates on case law, new legislation and academic commentary * A test bank of 150 multiple choice questions with answers and feedback * Extra material to enable students to find out more about areas of particular interest, such as incapacity and illegality

Product Description

This is the new edition of the well-established core text Anson’s Law of Contract, written by a leading academic in the field. Professor Beatson offers the reader an accurate statement of the law and its underlying principles, presenting an authoritative, fully revised and updated account of Contract Law. There is a full discussion of such key legislation as the Contracts (Rights of Third Parties) Act, 1999, The Electronic Communications Act, 2000, The Late Payment of Commercial Debts (Interest) Act, 1998 and The Unfair Terms and Consumer Contracts Regulations, 1999. Key cases such as The Royal Bank of Scotland v. Etridge, Johnson v. Gore Wood & Co and Director General of Fair Trading v. First National Bank plc are also discussed.

While this book is concerned with English Law, there are brief references to the approach of other European systems and international conventions where these might be of use in giving another perspective to problems faced by English law. This is particularly so where, as in the case of the use by the Unfair Terms in Consumer Contracts Regulations of the civilian concept of good faith, these are now directly relevant to English law.

The book also seeks to locate the Law of Contract within the wider context of the Law of Obligations and to address overlaps between Contract and Tort and between Contract and Restitution at appropriate stages. The twenty-eighth edition of this renowned textbook is essential reading for any student of the Law of Contract, and a valuable source of reference for practitioners and academics.

Product Description

This new casebook by Professor Burrows offers undergraduate law students the ideal way to discover and understand contract law through reading highlights from the leading cases. Designed to be used in conjunction with a contract law textbook, it covers the entire undergraduate contract law course in a series of clearly presented and carefully-structured chapters. Professor Burrows provides an expert introduction to each topic and his succinct notes and questions seek to guide students to a proper understanding of the cases. A principled analysis is also given of the relevant statutes. In addition to cross-references to further discussion in the leading textbooks, an innovative feature is the summary of leading academic articles in each chapter.

The book is designed not to overwhelm students by its length, and does not cover all aspects of the law of contract but only those most commonly found in the undergraduate curriculum. So, for example, it does not cover illegality given that that subject is now not regularly taught to undergraduates. Part one: The Formation of a Contract, covers: Offer and Acceptance; Certainty and Intention to Create Legal Relations; and Consideration and Promissory Estoppel.

Part two: The Terms of a Contract, covers: Identifying the Terms; Interpreting the Terms; and, Statutory Control of Unfair Terms. Part three: Remedies for Breach of Contract, covers: Termination; Damages; and, Direct Enforcement. Part four: Privity and Third Party Rights, covers Privity and Third Party Rights. Part five: Factors Allowing Escape from a Contract, covers: Misrepresentation; Mistake; Frustration; Duress; and, Undue Influence and Exploitation of Weakness.
